Divorce & Legal Separation

Divorce certainly is not a minor decision – it is one of the most life-changing choices that you can make for you and your family. We genuinely care about the outcome. Whether you have been served with a Petition for Dissolution of Marriage or you are thinking about filing for divorce, but do not know what to expect, the Court has provided legal steps you will need to follow, and Naimish & Lewis is here to help guide you through this difficult process.

Child Custody & Visitation

Child custody and visitation is often the most difficult part of a divorce as the laws surrounding custody and visitation can be confusing and complex. Custody orders in California must be made according to the best interests of the child – not according to the parent’s interests nor to achieve equity between the parents.

Child Support

California law states that biological parents of a child have a financial obligation to support their child until the child has reached the age of 18 and has graduated high school. The financial obligation could continue if the child has turned 19 and is still in high school and is not self-supporting. In the case of a disabled child that is not self-supporting, both parents have the legal obligation to continue to support the child for as long as necessary. Remember, child support is a legal right of a child and cannot be waived by either parent in a proceeding.

Spousal Support

During a divorce or legal separation, finances are often a point of contention and stress between the parties involved. In some cases, one spouse has stayed at home raising the children while the other was the sole income earner. In other cases, one spouse may make more money and as a result, be responsible for the payment of many of the household expenses. Division Of Assets and Debts

The State of California is a community property state, which means all assets and liabilities you and your spouse acquire during the course of your marriage are both of yours and therefore must be equally divided in a dissolution of marriage or legal separation proceeding. Property that one spouse owned before the marriage, in most cases, is considered separate property and is not subject to this same division.

Post-Judgment Modification & Enforcement Orders

There are several Family Court orders that can be changed over time as the parties’ circumstances do. The initial orders can be modified before or after the Court enters a final Judgment. This means that even though a divorce, legal separation, or parentage action is concluded, the parties may need to return to Court later if the orders are no longer appropriate.

PRE-NUPTIAL AND POST-NUPTIAL AGREEMENTS

For Premarital Agreements to be enforceable, the parties must follow the requirements set out in the Uniform Premarital Agreement Act found in California’s Family Code. If the parties do not follow these requirements, then they will not be able to determine how property is characterized and divided upon death or divorce, or how the law will dictate their financial obligations toward each other, creditors, or tax authorities.

ESTATE PLANNING, PROBATE AND TRUSTS

Estate planning is the process of anticipating and arranging for the distribution of an estate after a person dies as well as taking care of the person and the person’s assets while they are unable to do so due to incapacity. Estate planning attempts to eliminate uncertainties over the administration of an estate, avoid the delays and costs of probate administration, and helps to maximize the value of the estate by reducing taxes and other expenses. Guardians can be designated for minor children and custodians can be designated for pets.
